RESOLUTION OF THE TISHOMINGO COUNTY, MISSISSIPPI BOARD OF SUPERVISORS

Be it resolved that the Tishomingo County, Mississippi Board of Supervisors met at their regular meeting on the 15th day of July, 2024 for the purpose of passing a resolution as required by House Bill 1782 which amended Chapter 928 of Local and Private Laws of 2015, and having considered the statutory requirements imposed upon the board of Supervisors to which requires Board to provide for an election for the Board of Commissioners of the Tishomingo County Water District and upon a motion by Supervisor Eric Booker, a second by Supervisor Jeff Holt and unanimous vote of the Board, the Board does hereby find and resolves as follows:

The Tishomingo County Board of Supervisors finds that the Mississippi Legislature passed and the Governor approved Mississippi House Bill 1782 and the Bill became law after passage which requires that the Board of Supervisors provide for an election of the Board of Commissioners for the Tishomingo County Water District and further requiring that said election be held on the first Tuesday of September 2016 and on the first Tuesday of September every five years thereafter. The Board further finds that said House Bill 1782 mandated that the election would be an “at large” election with the top five persons receiving the highest number of votes will be elected to serve as Board of Commissioner members for five year terms. The candidates receiving the five (5) highest vote totals will take office on the first Monday of October following the election held in September, 2024. The votes shall be counted and the results published by posting the results on the door of the office of the Tishomingo County Water District office in written form noting the results of said election.

The Tishomingo County Board of Supervisors finds and resolves that pursuant to House Bill 1782 from the 2016 Mississippi Legislative session an election for the Board of Commissions will be held by paper ballot at the Tishomingo County Water District office located at 117 East Eastport Street, Iuka, Mississippi 38852 on Tuesday September 3, 2024 and the voting hours shall be between the hours of 8:00 a.m. and 6:00 p.m. at the Tishomingo Water District Office. The Board further finds and resolves that the election will be conducted by the Tishomingo County Election Commissioners and the results will be tabulated by the Election Commissioners and the results will be posted on the door of the Tishomingo County Water District office after the result tabulations are concluded and certified by said Election Commissioners.

The Tishomingo County Board of Supervisors finds and resolves that pursuant to said House Bill 1782 the qualifications for the office of Board of Commissioner for the Tishomingo Water District are specified that a Candidate for said office shall have the following qualifications:

1. A person must be at least twenty-five (25) years of age;

2. A person must be a water meter holder of the Tishomingo County Water District;

3. A person must be a resident of the service boundaries of the Tishomingo County Water District areas where water service is presently being provided;

4. A person must not be precluded from being bonded in the sums and manner as required by Section 19-5-171(2) of the Mississippi Code of 1972 which requires that each Commission elected or appointed as a commissioner, before entering upon the discharge of the duties of the person’s office, shall be required to execute a bond payable to the State of Mississippi in the penal sum of not less than Fifty Thousand Dollars ($50,000.00) condition that the person will faithfully discharge the duties of the office. Each bond shall be approved by the Clerk of the Board of Supervisors and filed with the Clerk.

The Board further finds and resolves that the qualifying for the Office of Board of Commission shall begin on the first Monday in August of 2024 and shall continue for twenty-one calendar days thereafter. The Board finds and resolves that if the final day for qualifying should fall on a weekend or holiday then the qualifying period shall be extended until closing hours for the Tishomingo County Water District Office on the next business day.

The Board further finds and resolves that the candidates for the office of Water District Commission may obtain an application to qualify at the Tishomingo County Circuit Court Clerk’s Office or the Tishomingo County Water District Office. All qualifying forms must be submitted to the office of the Tishomingo County Water District Office or the Tishomingo County Circuit Court Clerk’s office by close of business on the last day for qualifying for said office.

The Board further finds and resolves that after the election has been conducted and the results tabulated and certified by the Tishomingo County Election Commissioners, the candidates receiving the five (5) highest vote totals will be sworn into office after taking the prescribed oath of office which shall be administered by the Circuit Clerk of Tishomingo County, Mississippi.

The Board further finds and resolves that the Notice of Election, Qualifications and this Resolution shall be posted on the front door and bulletin board at the Tishomingo County Courthouse, the door of the Tishomingo County Water District and published in a paper of general circulation within Tishomingo County, Mississippi for a period of three consecutive weeks prior to the election with the date of the last publication being twenty-one (21) days or more prior to the date of the election.

The Tishomingo County Board of Supervisors further finds and resolves that the Mississippi Legislature, through local and private bill, repeal House Bill 1680 and introduce and pass legislation in substantially the following form so as to provide for the election of Commissions to govern the Tishomingo Water District.
